The following terms and conditions apply for all orders made by consumers and traders through our online shop.
A consumer is any natural person who concludes a legal transaction for a purpose that predominantly cannot be attributed to either their commercial or independent, professional activity. A trader is a natural person or legal entity or a private company with legal capacity, which, in concluding a legal transaction, is performing its commercial or independent, professional activity.
With regard to traders, these terms and conditions also apply for future business relationships without us having to refer to these again. If the trader uses opposing or additional general terms and conditions, we hereby object to the validity of these; they shall only form part of the contract if we have expressly agreed to them.
The purchase agreement comes into existence with the company that operates the online shop on behalf of the company!
By listing the products in the online shop, we provide a binding offer to conclude a contract based on these items. You can add our products to your basket initially without making a commitment and change your entries at any time before sending your binding order by using the tools intended and illustrated for this purpose in the ordering process. The contract comes into existence by clicking the order button to accept the quote for the goods in your basket. Immediately after sending the order, you will receive confirmation again via email.

Shipping costs are also added to the product prices listed. Further details on the shipping cost amount are provided with the quote.
We only use the shipping method to supply goods; unfortunately it is not possible to collect the goods yourself.

With the advance payment option, we provide you with our bank details during order confirmation and deliver the goods after we have received payment.
Your credit card is charged when you complete your order.
You pay the invoice amount via the online provider PayPal. You must generally be registered with PayPal / sign up first, authorize your login details, and confirm the payment instruction to us (with the exception of guest access, if applicable). Additional information is provided during the order process.
We also provide a Sofort transfer option. With this method, we receive the credit transfer instantly. This therefore speeds up the whole order process. To use this option, all you need is your account number, sort code, PIN, and TAN. The Sofort bank transfer sets up a transfer automatically and in real-time in your online bank account using a secure payment form from Sofort AG, which cannot be accessed by retailers. The purchase amount is then transferred immediately and directly to the retailer's bank account. If you select the Sofort transfer method, a pre-populated form opens at the end of the order process. This already includes our bank details. The transfer amount and the reference also already appear in the form. You must now select the country in which you hold your online banking account and enter your sort code. Then enter the same details you use to log on to online banking (account number and PIN). Confirm your order by entering your TAN. Immediately after this, you will receive confirmation of the transaction. Generally anyone who uses the Internet can use the Sofort transfer payment option if they have an active online banking account with PIN/TAN method. Please note that a a few banks still do not offer the Sofort transfer method. The goods shall remain our property until payment has been made in full.
Also applicable to businesses: Goods shall remain our property until full settlement of all outstanding bills from the current business relationship. You may resell the retained goods as part of normal business operations; you must transfer all receivables arising from this resale to us in advance for the total invoice amount – regardless of whether the reserved goods are combined or mixed with a new item – and we accept this transfer. You retain authority for collecting the outstanding funds, although we may also collect the funds ourselves if you do not meet your payment obligations.
Applicable to consumers: If goods are delivered with obvious damage caused by transportation, please advise the delivery agent about this incident immediately and contact us straightaway. If you do not make a complaint or contact us, this does not affect your statutory rights or the assertion of such, particularly with regard to your statutory warranty rights. However, it would help us make our own claim against the transport carrier and/or transport insurance.
Applicable to businesses: The risk of accidental loss and accidental deterioration is transferred to you as soon as we send the item to the shipping company, transport carrier, or any other person or establishment assigned with the delivery of the item. The obligation to inspect for and notify of defects governed in § 377 of the Commercial Code (HGB) applies to traders. If you fail to provide the notification governed in this provision, the goods are considered approved unless it concerns a fault that was not noticeable when inspecting the goods. This does not apply if we have deliberately concealed the defect.
Provided it is not otherwise explicitly agreed, the statutory warranty rights shall apply.
For consumers, the period of limitation for claims for defects in relation to used items is one year from delivery of the goods.
For businesses, the period of limitation for claims for defects is one year from the passing of risk; the statutory periods of limitation for the right of recourse according to § 478 of the German Commercial Code remain unaffected.
With regard to businesses, only our own information and the manufacturer's product descriptions included in the contract apply as the agreement in relation to the procurement of goods; we shall not be held liable for public statements made by the manufacturer or for other advertising messages.
If the item supplied is faulty, we shall initially fulfill our warranty to companies, at our discretion, by rectifying the fault or by delivering an item that is not faulty (replacement).
The above limitations and reduction of time limits shall not apply to claims based on damages caused by us, our legal representatives, or agents

For all claims due to damages caused by us, our legal representatives, or agents, we assume liability
In the event of breaches to the integral contractual obligations – the fulfillment of which facilitates the proper execution of the contract in the first place and the compliance of which the contract partner can regularly rely upon (cardinal duties) – caused by slight negligence by us, our legal representatives, or agents, the liability is limited to the level of damage foreseeable at the time the contract was concluded, the occurrence of which must be envisaged on a typical basis.
Incidentally, claims for damages are excluded.
If your order includes goods that are subject to age restrictions, we use a reliable procedure involving personal identity and age verification to ensure that the person ordering has reached the minimum age requirement. The person delivering the goods only hands them over after proof of age is verified and only to the person who ordered.
If you are a business, German law shall apply with the exclusion of German purchasing law.
If you are a trader in the sense of the German commercial code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationships between us and you is 6020 Innsbruck.
